Terms of Service for Redtail Quiz App

Welcome to Redtail Quiz App (“Redtail,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile application, and other digital platforms (collectively, the “Redtail Service” or “Service”), which help transform your study materials into gamified, adaptive quizzes. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.  

 1. Eligibility  

You must be at least 13 years old to use the Redtail Service. By using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you must have the consent of a parent or legal guardian to use the Service.  

 2. Account Registration and Security  

- Account Creation: To access certain features of the Service, you must create an account using your email address and a password. You agree to provide accurate and complete information during registration and to keep your account details up to date.  

- Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at redtailappinfo@gmail.com if you suspect unauthorized access to your account. We are not liable for any loss or damage resulting from your failure to protect your account information.  

 3. Use of the Service  

- Permitted Use: The Redtail Service allows you to upload study materials (e.g., text, images, or other files) to generate personalized quizzes. You may use the Service solely for personal, non-commercial educational purposes unless otherwise agreed in writing with us.  

- Prohibited Conduct: You agree not to:  

  - Use the Service for any illegal, harmful, or unauthorized purpose.  

  - Upload content that is offensive, infringing, or violates the rights of others (e.g., copyrighted material without permission).  

  - Attempt to reverse-engineer, hack, or interfere with the Service’s functionality or security.  

  - Use the Service to distribute spam, malware, or other harmful content.  

- Content Ownership: You retain ownership of the study materials you upload (“User Content”). By uploading User Content, you grant Redtail a worldwide, non-exclusive, royalty-free license to use, process, and store such content solely to provide and improve the Service (e.g., generating quizzes using OpenAI API and Whisper AI for text extraction). We do not claim ownership of your content and will not use it for purposes beyond those necessary for the Service.  

 4. Third-Party Services  

The Redtail Service relies on third-party providers for certain functionalities:  

- OpenAI API: Used for quiz generation from uploaded content.  

- Whisper AI: Used for text extraction to create quizzes.  

- Heroku: Hosts our backend infrastructure.  

- Firebase: Stores user account details and data.  

These providers operate under their own terms and privacy policies, which we encourage you to review. We are not responsible for their actions or services.  

 5. Intellectual Property  

- Redtail Ownership: The Service, including its design, features, and underlying technology, is owned by Redtail or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.  

- Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.  

 6. Privacy  

Your use of the Service is subject to our Privacy Notice, available at https://redtailapp.com/articles/privacy-policy . Please review it to understand how we collect, use, and protect your information.  

 7. Termination  

- By You: You may terminate your account at any time by contacting us at redtailappinfo@gmail.com with “Account Termination” in the subject line.  

- By Redtail: We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, if you violate these Terms, engage in harmful behavior, or for any other reason we deem necessary to protect the Service or other users.  

- Effect of Termination: Upon termination, your account and access to the Service will be discontinued, and we may delete your data in accordance with our Privacy Notice.  

 8. Limitation of Liability  

- Disclaimer of Warranties: The Redtail Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy, completeness, or uninterrupted availability of the Service.  

- Limitation of Liability: To the maximum extent permitted by law, Redtail and its affiliates, officers, and agents will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim related to the Service will not exceed the amount you paid (if any) to use the Service in the preceding 12 months.  

 9. Indemnification  

You agree to indemnify and hold Redtail, its affiliates, officers, and agents harmless from any claims, losses, or damages, including legal fees, arising from your use of the Service, violation of these Terms, or infringement of any third-party rights through your User Content or actions.  

 10. Changes to These Terms  

We may update these Terms from time to time without prior notice. Changes will be effective as of the updated date listed at the top of this document. By continuing to use the Service after updates, you agree to the revised Terms. We encourage you to review these Terms periodically.  

 11. Governing Law and Dispute Resolution  

These Terms are governed by the laws of [Insert Jurisdiction/State/Country, e.g., “the State of California, United States”] without regard to conflict of law principles. - No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
